Terms of Use

1. Operator and acceptance

ArkC3D is operated by a sole proprietor in Japan under the trade name GipnoArkSystems. By using ArkC3D, and by purchasing or using CSV Export, you agree to these Terms. If you do not agree, do not purchase or use the paid feature.

2. ArkC3D service

ArkC3D is a browser-based C3D inspection and data-export tool intended for research, education, and engineering workflows. C3D files are processed locally in the browser. ArkC3D does not require a user account.

3. CSV Export license

CSV Export is sold for US$19.00 as a one-time purchase with no subscription. One license is granted to one natural person. The licensed person may use the same License Key on multiple computers and browsers that they personally use.

The License Key may not be shared with, transferred to, sublicensed to, or resold to another person. An organization may pay for a license, but each license authorizes use by only one natural person.

The license itself has no scheduled expiration. CSV Export requires online license verification each time an export is initiated and depends on the availability of ArkC3D and its licensing infrastructure. No perpetual service availability, hosting period, compatibility period, or infrastructure lifetime is promised.

4. Payment and delivery

Checkout, payment processing, applicable tax calculation, receipts, order records, and License Key issuance are handled through Lemon Squeezy as the Merchant of Record. The final amount payable, including applicable taxes, is shown during checkout. CSV Export becomes usable after a valid License Key is issued and successfully verified by ArkC3D.

5. Refunds

Refund requests are governed by the Refund Policy. A refunded or charged-back purchase no longer grants a right to use CSV Export, and the associated License Key may be disabled.

6. Support, updates, and changes

Questions about defects or licensing may be sent to [email protected]. The purchase price does not include a service-level agreement, a guaranteed response time, a guaranteed support period, guaranteed future updates, or guaranteed new features.

ArkC3D may change, replace, suspend, or discontinue features when reasonably necessary. If ArkC3D or its licensing infrastructure is discontinued, GipnoArkSystems will make reasonable efforts to provide advance notice when practicable. Permanent service availability and an offline-unlock release are not guaranteed. Any change remains subject to rights that cannot be excluded under applicable law.

7. Terms version for purchased licenses

The material license scope of a purchased CSV Export license remains governed by the Terms version accepted when that purchase session was created. Later Terms versions do not retroactively reduce the core license scope of an existing purchase, except to the extent a change is required by applicable law.

8. User data and rights

GipnoArkSystems does not claim ownership of a C3D file opened by a user or of a CSV file generated from that user's data. You are responsible for ensuring that you have the rights and permissions required to use the source data and to create, use, or distribute any exported data.

9. Permitted use and medical disclaimer

ArkC3D is intended for research, education, and engineering use. It is not a medical device and does not provide medical advice. It is not intended to serve as the sole basis for clinical diagnosis, treatment decisions, legal decisions, or other high-stakes determinations.

You are responsible for validating important data, calculations, interpretations, and scientific conclusions using appropriate software, source records, and domain expertise.

10. Restrictions

You may not:

• share, publish, sell, or distribute a License Key;
• circumvent or interfere with CSV Export license verification or access controls;
• misrepresent yourself as an authorized operator or reseller of ArkC3D; or
• use ArkC3D in violation of applicable law or the rights of another person.

11. Accuracy and warranties

ArkC3D is not a complete C3D validator. To the extent permitted by applicable law, ArkC3D is provided without warranties that its output will be complete, error-free, scientifically valid, continuously available, or suitable for a particular purpose. Vendor-specific extensions, unsupported processor formats, malformed source data, and other conditions may affect results.

12. Limitation of liability

To the maximum extent permitted by applicable law, GipnoArkSystems is not liable for indirect, incidental, special, consequential, or loss-of-data damages arising from use of ArkC3D. For claims relating to a paid CSV Export license, the aggregate liability of GipnoArkSystems is limited to the amount you paid for that license. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

13. License termination

The CSV Export license may be disabled when the purchase is refunded or charged back, when the License Key is shared or transferred in breach of these Terms, or when use of the license otherwise materially violates these Terms. Disabling a license does not convert an invalid entitlement into a successful verification.

14. License compliance data and privacy

ArkC3D records limited pseudonymous CSV Export authorization data to investigate suspected License Key sharing, abuse, security issues, and support cases. Such technical signals are not, by themselves, treated as proof of a violation.
